There are many different rules governing the ability of foreign national individuals to enter the UK to join their family members and what they can do once they arrive. We have a vast amount of experience in dealing with the applications of family members of British citizens and individuals with leave under the points based system.

Submitting an application for a family member to join you in the UK can be an incredibly stressful experience but we are able to guide you through every stage of the process, from advising on the options available to individuals based on their and their family’s circumstances to preparing and submitting the application and advising on the conditions of leave. In all circumstances we look at the whole picture to decide on the best option, both in terms of the initial application for leave to enter and ensuring families can legally remain together in the UK.

Examples of our family relationship applications work include:

  • Advised an unmarried partner of an EEA national on securing a residence card which involved successfully arguing that the Home Office should exercise its discretion in waiving the requirement for the couple to have lived together for two years.
  • Advised family members of EEA nationals on the requirements of obtaining permanent residence in the UK in circumstances where the family relationship had broken down.
  • Advised numerous clients on securing leave to remain in the UK on a UK ancestry visa and, in many cases, advised their spouses on also obtaining leave to remain in the UK.
  • Advised the family members of British citizens on the requirements for obtaining leave to enter and remain in the UK.

Biography

Amy qualified as a solicitor in May 2015 and joined Teacher Stern LLP in January 2018 as a member of the Immigration team. She advises on immigration and nationality law for private individuals and corporate clients.

She has extensive experience of making applications under the Points Based System, with expertise of applications for Skilled Workers (formerly Tier 2) skilled migrants and advising SMEs to apply to be added to the list of registered sponsors. Amy also advises individuals wishing to apply as Sole Representatives, Investors and those previously granted leave under the Entrepreneur category.

Amy has provided advice to numerous European nationals and their family members on the impact of Brexit. She has significant experience of submitting applications under both the EEA Regulations and the EU Settlement Scheme.

Amy has submitted applications for the family members of British nationals and settled persons, including applications based on complex finances. She has helped clients make successful applications for leave to be granted outside of the Immigration Rules and on a discretionary basis.

She is also experienced at dealing with complex nationality matters, such as those who exceed the relevant absence thresholds to naturalise. Amy also regularly assists clients to register as British on a discretionary basis and with complex applications to the Passport Office.

Amy is an active member of the Immigration Law Practitioners Association (ILPA).
